The General Terms and Conditions of Sale describe the terms and conditions of distance selling between the seller, within the framework of The Travelling Lovers' marketing of a tailor-made consulting service for the purpose of creating a travel itinerary, and the customer. They express the entirety of the obligations and rights of the Parties. The Terms and Conditions apply without restriction or reservation to any purchase of services made online through the website.

1 - Purpose of the Contract

The Traveling Lovers provides consulting and research services on destinations, transportation, accommodation, and activities. The purpose of the contract is to create a personalized and tailor-made travel diary for the destination. Various services and packages are listed on the website. Obtaining services through this website constitutes the Buyer's unconditional acceptance of these Terms and Conditions of Sale, and the Buyer acknowledges having read these Terms and Conditions before placing an order. Before entering into any transaction, the Buyer declares, on the one hand, that the services purchased are for strictly personal use and, on the other hand, that they have full legal capacity to make the commitments under these General Terms and Conditions of Sale. The Buyer acknowledges having received the necessary advice, information, and research to ensure that the offer is suitable for their needs.

2 - Products and Services

The website www.thetravellinglovers.fr offers advice and assistance for organizing tailor-made trips. This includes finding transportation, accommodation, and activities in a specific destination. The service also includes writing, graphic design, and the printing and shipping of paper guides to the client's address. The service does not include booking the services provided, as these services will be reserved by the client. The main characteristics of the services offered, including specifications, illustrations, and their respective prices, are made available to the Client on the The Travelling Lovers website. Clients must read these characteristics before ordering. The selection and purchase of services are entirely the client's responsibility.

3 - Ordering Terms

Users can contact The Travelling Lovers via its website, forms, social media, Instagram and Facebook, as well as by email. The Company and the Client will arrange a free, no-obligation telephone appointment. Users will be able to share their expectations and wishes so that we can best meet their needs and create a quote and then a personalized travel diary (digital or paper) when the user places their order. The Company undertakes to provide users with quotes within a maximum of 72 hours. Once the user accepts the quote and pays the deposit, The Travelling Lovers will begin the necessary research as quickly as possible, whether via the internet, paper guides, or their own knowledge and experience.The Travelling Lovers will contact the Client at several stages of the trip planning process, including to confirm certain services, accommodations, and transportation. The Client will receive emails from The Travelling Lovers containing booking links for the selected services. The Client agrees to book these services as soon as possible in order to benefit from the conditions found by The Travelling Lovers. We cannot be held responsible for price increases or changes in availability of the suggestions made. The Travelling Lovers will then forward the final travel guide. If the Client wishes to modify any element of their trip, The Travelling Lovers undertakes to carry out the necessary research at no additional cost. Once the travel guide is printed, no further changes may be made to the trip by the Client. ​

4 - Delivery

The digital travel journal will be provided to the buyer in PDF format. The paper travel journal will also be available, upon request, and can be delivered in person or sent by post within mainland France only.

5 - Prices

The final price is stated in euros, inclusive of all taxes (VAT). The Services offered by the Provider are provided at the rates in effect on the website www.thetravellinglovers.fr. The price includes: A study of the client's needs Personalized research carried out at the Client's request The creation and delivery of a digital travel diary The price does not include booking providers selected by The Travelling Lovers, as this exceeds its legal capacity (only a travel agency registered with Atout France can manage travel service bookings). The Travelling Lovers reserves the right to modify its prices at any time, while guaranteeing that the price indicated at the time of the order will be applied. ​

6 - Payment Terms

When the quote is accepted, the buyer agrees to pay a deposit within 72 hours. The deposit is 50% of the total price, including VAT. The remaining balance must be paid before receipt of the final travel document, upon invoice for the balance. The service will only begin after payment of the deposit or full payment. The Travelling Lovers will confirm the Order by email. If the deposit or the full amount is not paid within the agreed timeframe, The Travelling Lovers reserves the right to cancel or delay the performance of the service. The Travelling Lovers is not subject to VAT pursuant to the provisions of Article 293 B of the French General Tax Code. The following payment methods are available to the buyer to order and pay for the selected services: Bank transfer (the Company's bank details appear on the quote and invoice) Payment via the secure Lydia platform (all necessary information is also visible on the quote and invoice).

7 - Right of Withdrawal ​

Pursuant to Article L121-28 of the French Consumer Code, the Customer has twenty-four hours from the date of confirmation of their order to exercise their right of withdrawal for all orders for services such as travel research and/or organization.

8 - Liability

The Travelling Lovers is committed to providing the best possible service to its Clients, offering them a tailor-made and personalized trip, in line with their initial request. The Travelling Lovers cannot be held responsible for the failure to book the proposed transportation and/or accommodation. The Travelling Lovers cannot be held responsible for incorrect information. The Client must provide the correct information and verify the accuracy of their data (departure airport, travel dates, information on accommodation or other services, etc.) in advance. Any change of destination, date, or other information requiring a complete new trip search cannot be processed or will require a new package. The Travelling Lovers cannot be held responsible for any dispute between the buyer and any of the service providers selected for the trip (transportation company, accommodation, excursion company, tour operator, or any other person involved in the proposed trip). The Traveling Lovers cannot be held responsible for the poor running of a trip, flight or train cancellations, poor travel experiences, accommodations, or any other service. The booking of the trip is the sole responsibility of the Client.

9 - Intellectual Property

All technical documents, products, drawings, and photographs provided to buyers remain the exclusive property of The Travelling Lovers, the sole holder of intellectual property rights to these documents, and must be returned to the buyer upon request. No rights of any kind are transferred by The Travelling Lovers to the Client regarding the media transmitted during the performance of the Services. The Client undertakes not to use these documents in any way that could infringe The Travelling Lovers' industrial or intellectual property rights. The Client undertakes not to disclose them to any third party.

10 - Personal Data

The Travelling Lovers Company undertakes not to disclose any personal information about the user or buyer. All information concerning them is subject to the provisions of Law No. 78-17 of January 6, 1978.

 

11 - Disputes, Applicable Law, and Language

These general terms and conditions are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute. In the event of a dispute between the consumer customer and our company, the applicable law is French law. The French courts have sole jurisdiction to settle the dispute.
